According to a report in the USA Today,the60-year-old French actor alleged that during a September 26 altercation, Halle Berry “physically abused our son, Maceo, by jumping on him, putting her hands around his neck, and choking him.”
However, Berry has denied Martinez's allegations, calling the filing “entirely meritless and deliberately misleading.”

According to an exclusive report in Page Six,Halle Berry has blamed Olivier Martinez for her son’s behavioral issues at school.
The Catwoman actress has accused her ex-husband of repeatedly being a hindrance to their son’s educational and therapeutic needs, using the legal system to bully her and attempting to alienate her from their son.
According to a report in People magazine, Martinez filed for a temporary restraining order and sole custody, claiming Berry physically abused Maceo during a September 26, 2026 incident, by allegedly jumping on and choking him.

Halle Berry strongly denies all abuse accusations, stating that she has never harmed her son, neither emotionally nor physically. She has described the September 26 incident as playful roughhousing that escalated into an argument and is asking the court to restore their 50-50 custody arrangement.
Berry’s court filings argue that Maceo has been manipulated by Martinez and returns from his father's house upset, combative, and aggressive. Berry's older daughter, Nahla, and Berry's fiancé have submitted statements supporting Berry and stating they have never observed any abusive behavior.
Berry and Martinez tied the knot in July 2013 in Château des Condé in Vallery, France, after getting engaged in 2012. The couple separated in 2015, two years into their marriage. Sources cited their fiery personalities and clashing priorities as the main reasons for their split. Before marrying Martinez, Berry was married twice, first to David Justice (1993-1997) and later to Eric Benét (2001-2005). Martinez was her third husband.

Martinez and Berry became parents to their son, Maceo, on October 5, 2013. The name “Maceo” comes from a Spanish word meaning “gift of God.” Berry reflected during a panel titled, “Women Breaking Barriers: An Industry Shift,” as per Peoplemagazine, on how she has been raising Maceo to be an independent thinker. She said:
“You made me think of how many conversations I've had with him, say, since he's turned 5 years old, about the differences in boys and girls, and I see how he's taught to feel like he's superior, at 5, than girls are.”
Berry shared her fear of sending her 18-year-old daughter off to college, describing the feeling as “scary.” She expressed pride and a mother's natural fear while hoping she raised her right.
At the 2021 People's Choice Awards, she dedicated her win to her children, saying:
“My two little kids, they have to lose so much time with their mommy because I get to go work and do what I love. So thank you, Nahla, thank you, Maceo. I hope you find something in life that you can love and you can do with as much vigor and as much zest as I do what I do. I love you guys.”
Berry met her former partner Gabriel Aubry in November 2005 on the set of a Versace advertising photoshoot. At the time, Berry worked as a spokeswoman and model for Versace, and Aubry was hired as a model for the luxury brand's campaign. They began dating shortly after their meeting and welcomed their daughter, Nahla, on March 16, 2008, in Los Angeles.
